Not at all, since Garcia was NEVER caught while attempting to illegally enter the United States I knew that section of the law did NOT apply to his circumstances therefore the fines and penalties mentioned in that section were immaterial to the conversation, and I suspect you knew that as well but for you to have used and continue to use a section of the law that you know does not apply is the same as lying.

He was never granted asylum because he applied more than 1 year after entering the US illegally.

In October 2019, an immigration judge decided Abrego Garcia shouldn't be removed because of violent gang threats he faced if he returned to El Salvador. Trump's Immigration and Customs Enforcement had 30 days to appeal that ruling. No appeal was filed, according to the court documents.

Granted that "withholding of removal" isn't identical to "asylum," it still means that he was here legally.

Improper time or place; civil penalties

Any alien who is apprehended while entering (or attempting to enter) the United States at a time or place other than as designated by immigration officers shall be subject to a civil penalty of-

(1) at least $50 and not more than $250 for each such entry (or attempted entry); or

(2) twice the amount specified in paragraph (1) in the case of an alien who has been previously subject to a civil penalty under this subsection.

Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed.


These penalties only apply if they are caught crossing the border illegally, not if they are found later. I can't find anything in the US Code about a penalty if they are found later. So you're right, the $50 fine wouldn't have applied at that point.

But it doesn't matter, you're just trying to distract from the topic. He was here legally, as you've already admitted... which means that he was subjected to a worse Constitutional violation than the Proud Boys. And as such should get the same or greater restitution.

Regardless, illegal immigration has a $50 fine, not life in a foreign prison. And even if he were not documented, he qualified for Constitutional rights.

In 2019, he was questioned by police regarding alleged ties to the MS-13 gang in New York, based on information from a confidential informant. A New York judge confirmed these ties, stating, "This gentleman came here illegally. He broke our laws." - Fox45 News

No he entered the US illegally.
Abrego Garcia grew up in El Salvador and then illegally immigrated to the United States in 2011 at the age of 16 to escape gang threats. In 2019, an immigration judge granted him withholding of removal status due to the danger he faced from gang violence if he returned to El Salvador. This status allowed him to live and work legally in the United States.

On either November 30 or December 1, 2022,[67] at a traffic stop on Interstate 40 in Tennessee, Abrego Garcia and eight others were pulled over by the Tennessee Highway Patrol for speeding and veering out of his lane.[27][39] Abrego Garcia said they were traveling to work a construction job.[27] The officer reportedly suspected it was a case of human trafficking since there was no luggage in the vehicle.[39] The Highway Patrol processed his driver's license and found that it was expired and contained a note to inform federal officers due to alleged affiliation with MS-13. The agency contacted ICE, which declined to take Abrego Garcia into custody, and no charges were filed against him.[27]

Garcia was a legal immigrant, illegally sent to a prison in El Salvador in March. He was denied multiple Constitutional rights, including the right to a trial. This prison is infamous for systematic physical beatings, torture, as well as intentional denial of access to food, water, clothing, toilets, and healthcare. We know that at least 368 prisoners have died in the prison from this abuse.

Trump also repeatedly slandered the man on public television.

The Supreme Court ordered Trump to bring him back in April, an order with Trump refused.

He was finally brought back this week, only to face Trumped-up criminal charges that have no basis in fact.

If you agree that we should give anywhere from $5 million to $20 million to insurrectionists that claim their rights were violated by being arrested... how much should we give Garcia?

The leader of the insurrection, Enrique Tarrio, spent 4 months in the DC jail... about the same amount of time as Garcia. So their financial settlement should be at least the same, right? Arguably he should get more, since I'm sure the El Salvadorian prison was infinitely harder than the DC jail...
